Terms of Use

Thank you for choosing BuyHostingNow, Inc (hereinafter referred to as BuyHostingNow, we, us, our) as your hosting partner. This Terms of Service (TOS) outlines the relationship between BuyHostingNow and the individual who or entity which registered for services with BuyHostingNow (hereinafter referred to as User, you, your).

This TOS is to be read in conjunction with our Privacy Policy and Acceptable Use Policy (AUP).

Please read these policies carefully, because by registering with BuyHostingNow, you are agreeing to be bound by and to abide by them. The effective date of this TOS is the date registered with us. BuyHostingNow reserves the right to modify this TOS as needed.

1. DEFINITIONS

  • 1.1. Account: A personal or business arrangement (account) created by registering with BuyHostingNow to access its services.
  • 1.2. Service: The specific hosting package purchased by a User from BuyHostingNow.
  • 1.3. Service Owner: The legal owner of the Account and purchaser of specific services offered by BuyHostingNow.
  • 1.4. Support Ticket: An issue tracking system that manages communication between BuyHostingNow and a Service Owner on issues related to specified services or their Account.
  • 1.5. User: A client of BuyHostingNow or the service owner of an Account with BuyHostingNow.
  • 1.6. Violation Fine: Charges levied against an account for violation of the Terms of Service or Acceptable Use Policy.


2. USE OF PRODUCTS AND SERVICES

  • 2.1. Our products and services are open to anyone of the legal age to enter and form a binding contract as long as you are not barred from accessing such services under the laws of Canada or your specific residential jurisdiction
  • 2.2. To access any of our services, you are required to register and provide current and accurate identification information, contact information, and any other details as required for the registration process.
  • 2.3. You are solely responsible for all activities that take place under your account and are responsible for maintaining the accuracy and confidentiality of your account information. If you believe that your account has been breached or there was any unauthorized use, you agree to immediately notify BuyHostingNow.
  • 2.4. BuyHostingNow is not liable for any loss or damage that arises from the User’s failure to supply accurate information or to keep their account details secure.
  • 2.5. BuyHostingNow reserves the right, at any time, to terminate, cancel or suspend a User’s access to BuyHostingNow services for any reason and without notice. A User’s right to use the service ceases immediately upon suspension or cancellation or termination. You will not be able to access data stored on the service after suspension or termination. Therefore, you are responsible for backing up any data stored or used with the service.
  • 2.5.1. If your service is terminated without cause, we will refund the amount of your payment as per the corresponding portion of the service remaining at the time your service was terminated.


3. CONDITIONS OF USE

  • 3.1.You agree that violations as per our Acceptable Use Policy are classified as prohibited usage and may result in the immediate suspension and/or termination of your Account and Service without compensation.
  • 3.2. You agree that Intentional/Malicious Violations as per our Acceptable Usage Policy are grounds for immediate termination of your Services and Account with BuyHostingNow and will result in a ban for any future service.


4. ACCOUNT REGISTRATION

  • 4.1.CONTACT INFORMATION
  • 4.1.2. Users are required to provide their legal names (First/Given Name, Surname) and residential address to register an Account with BuyHostingNow.
  • 4.1.3. We do not accept Post Office (P.O.) Boxes, non-residential/mailing addresses or mail forwarding addresses.
  • 4.1.4. We do not require a valid telephone number to register an Account.


4.2. RESTRICTIONS

  • 4.2.1. Users are not allowed to open more than one (1) personal account.
  • 4.2.2. Users should not give access to their accounts to other indiviuals.


5. BILLING

  • 5.1. PROPORATIONAL RATE
  • 5.1.1. Recurring services are billed on a proportional rate basis with the recurring due date for payments being the first day of each month.
  • 5.1.2. For orders placed before the 20th day of each month, Accounts will be billed for the remainder of the month and the ensuing due date for payment would be the first of the next month.
  • 5.1.3. For orders placed on or after the 20th day of a month, the Account will be billed for the remainder of the month AND the entirety of the following month. The next due date will, therefore, be the first day of the month thereafter.
  • 5.1.4. Order requests for a Quarterly, Semi-Annual, Annual, Biennial or Triennial billing cycle will be invoiced for the remainder of the specific billing cycle. The next due date will be set for the full length of the billing cycle and it will start from the first day of the month that the first order was made.


  • 5.2. INVOICING
  • 5.2.1. Account holders for recurring monthly services are invoiced ten (10) days in advance of the payment due date which is the first day of each month.
  • 5.2.2. Invoices for recurring services billed over Quarterly, Semi-Annual, Annual, Biennial, and Triennial billing cycles will be issued to Account Holders fifteen (15) days in advance of the due date.
  • 5.2.3. Services with unpaid invoices after five (5) days past the due date will be suspended.
  • 5.2.4. Services with unpaid invoices after fifteen (15) days past the due date will be terminated.


6. PAYMENTS & REFUNDS

  • 6.1. ACCEPTABLE PAYMENT METHODS
  • 6.1.1. Payment for services is accepted via PayPal, Credit/Debit Cards and 2checkout.


  • 6.2. PAYPAL
  • 6.2.1. Payments made via PayPal transactions are eligible for a refund within the first seven (7) days of the initial order payment being processed.


  • 6.3. CREDIT/DEBIT CARDS & 2Checkout
  • 6.3.1. Payments made via Credit/Debit Card transactions are eligible for a refund within the first seven (7) days of the initial order payment being processed.
  • 6.3.2.Payments made via 2Chechkout will not be eligible for any refunds


  • 6.4. DISPUTE/CHARGEBACKS
  • 6.4.1. Payment disputes or chargebacks raised in respect of any payment for services will result in the immediate suspension of all services on the respective Account until the dispute is settled. The Service Owner will not be able to place any further orders on the account until resolved. BuyHostingNow reserves the right, at its discretion, to terminate all services on an Account without compensation in the event of a chargeback or dispute.


7. SERVICE PROCESSING

  • 7.1. SERVICE PROVISIONING
  • 7.1.1. Service orders placed during the outlined Business Hours are processed within 60-120 minutes provided that the User’s Contact Information is supplied and Payment made in accordance with this TOS.
  • 7.1.2. Service orders placed outside the outlined Business Hours are processed within 24-48 hours provided that the User’s Contact Information is supplied and Payment made in accordance with this TOS.
  • 7.1.3. If a User’s Contact Information and/or Payment details are not in accordance with this TOS, the order will be placed on hold and a Support Ticket opened to provide the User with details on how to resolve the issue.
  • 7.1.4. Orders that are on Hold for which no response is provided from the User more than 24 hours after the Support Ticket is opened will be canceled and a refund processed, if applicable.
  • 7.1.5. Orders that are unpaid for more than 24 hours will be automatically deleted from the system.


  • 7.2. SERVICE MODIFICATION
  • 7.2.1. Service modifications are made on accounts that are current. Invoices due for payment must be settled before a service modification request is processed. Service modification cannot be granted on the due date or if the payment due date is past.
  • 7.2.2. For service modifications that will lower the value of the existing service, the difference in value for the remainder of the billing cycle will automatically be credited to the User’s Account Credit Balance.
  • 7.2.3. For modifications that are higher in value than the existing service, the service will be billed for the difference in values from the date of modification until the end of the current billing cycle for the service. The modification will only be applied once the invoice generated for the modification is paid and settled.


  • 7.3. SERVICE TRANSFER
  • 7.3.1. An existing service may be transferred between Users in keeping under the following conditions:

    a. The service to be transferred must:

    • Have been active for at least three (3) months
    • Not have any overdue or unpaid invoices associated with the service
    • Not have had any TOS/AUP violoations on record


    b. The Account that is initiating the transfer must:

    • Be Active and have had at least three (3) continuous months of service history
    • Be in good standing and not have had any TOS or AUP violations


    c. The Account receiving the transfer must:

    • Be Active and have had at least three (3) continuous months of service history
    • Not have any overdue or unpaid invoices
    • Be in good standing and not have had any TOS or AUP violations
    • Accept the transfer


  • 7.4. SERVICE CANCELLATION
  • 7.4.1. Cancellations with immediate effect are automatically processed on the next following day.
  • 7.4.2. All end of cycle cancellations is automatically processed the following day.
  • 7.4.3. All related backups and data are destroyed as soon as a cancellation is processed and any IP addresses associated with the Service released for access by other Users. This process is not reversible.
  • 7.4.4. When a specific service is canceled before its due date, the Credit balance remaining on the Account as per the Service’s billing cycle will be automatically deposited to the User’s Account credit balance.


  • 7.5. SERVICE SUSPENSION
  • 7.5.1. Account/Service Suspensions mean that a service will be taken offline and disabled from being powered on or accessed by the User. The service will not be reinstated and no data made available until the reason for the suspension is resolved.


  • 7.6. SERVICE TERMINATION
  • 7.6.1. On termination of a User Account and Services, all related backups and data will be destroyed and any IP address associated with the Account/Service released and made available for new Users. This process is not reversible.


8. HOURS OF OPERATION

  • 8.1.1. BuyHostingNow provides 24-hour Support Mondays to Fridays. Support Tickets submitted on Saturdays and Sundays will generally be addressed within 8 hours.
  • 8.1.2. BuyHostingNow’s Billing Unit is opened from Mondays to Fridays. Billing inquiries outside of these hours will be processed in 24 hours
