Acceptable Usage Policy

This Acceptable Use Policy (“AUP”) governs the use of the hosting service provided by BuyHostingNow, Inc (hereinafter referred to as BuyHostingNow, we, us, our). BuyHostingNow reserves the right to modify this AUP without notice at any time. Any terms used in this UAP that is not defined has the same meaning as the terms defined in the Terms of Service Agreement.

The services provided by BuyHostingNow must only be used for lawful purposes. By choosing to use the services of BuyHostingNow, you are agreeing to comply with all laws, rules, and regulations applicable to your connection with or use of the BuyHostingNow services.
1. ABUSE DEFINITIONS

  • 1.1 RESOURCE ABUSE
  • 1.1.1. Account: Resource Abuse is defined as any activity that uses enough system resources (including but not limited to CPU, memory usage, and network resources) that it negatively affects other clients or equipment.
  • 1.2 UNSOLICITED COMMUNICATION
  • 1.2.1. Unsolicited Communication is any communication submitted via email by a User of BuyHostingNow services without the consent of the recipient.
  • 1.2.2. BuyHostingNow reserves the right to immediately terminate and permanently ban any future service or use of an account that is used purposefully or knowingly to permit or initiate Unsolicited Communication.


  • 1.3 MALICIOUS CONTENT
  • 1.3.1. Malicious content refers to any content that violates the laws of Canad as well as any and all types of code, script or other files that are meant to or perform harmful action whether it affects the User or is done as a bulk action triggered by the User.
  • 1.3.2. BuyHostingNow reserves the right to immediately terminate and permanently ban any future service or use of an account that is used purposefully or knowingly to permit or host Malicious Content.


2. REMEDIAL ACTION

  • 2.1. INTENTIONAL/MALICIOUS ABUSE
  • 2.1.1. Intentional/Malicious Abuse is classified as any action that is knowingly done by the User as outlined in the Abuse Definitions and which is performed by the User, its agents or anyone authorized to access or use the service on behalf of the User.
  • 2.1.2. Where a User has breached the Intentional/Malicious Abuse Requirement, but save and except where a court of law has ordered that evidence is handed over to law enforcement officials, all services of the User will be terminated with immediate effect and without any compensation subject to 2.2 – 2.4 below.
  • 2.1.3. A User found to be in breach of the Intentional/Malicious Abuse clause will be permanently banned from accessing any future service or holding any accounts with BuyHostingNow or any related companies.


  • 2.2. OFFENSES
  • 2.2.1.1. FIRST OFFENSE At the First Offense, the offending service will be taken offline. The account will also be placed in a suspended state.
  • 2.2.1.2. BuyHostingNow will open a Support Ticket with the owner of the service that will detail the offense and the remedial action(s) needed to resolve the issue.
  • 2.2.1.3. The Service Owner will be required to respond in writing to the Support Ticket to acknowledge that he/she understands the issue(s) for which the service was suspended and the requirements to correct the problem. BuyHostingNow will reactivate the Service and the Service Owner is required to prevent any further offense or abuse within 24 hours.


  • 2.2.2. SECOND OFFENSE
  • 2.2.2.1. At a Second Offense, the offending service will be taken offline and the account left in a suspended state.
  • 2.2.2.2. BuyHostingNow will open a Support Ticket with the owner of the service that will detail the offense and the remedial action(s) needed to resolve the issue.
  • 2.2.2.3. A Violation Fine of $200 will be issued to the Service Owner if the offense was found to be intentional or as a result of negligence.
  • 2.2.2.4. The account will be reactivated once the Service Owner responds in writing to the Support Ticket and acknowledges that he/she understand the problem(s) and what to do to correct said problem AND pays the AUP Violation Fine in full, after which the Service Owner has 24 hours within which to resolve the issue and prevent any further abuse.


  • 2.2.3. THIRD OFFENSE
  • 2.2.3.1. At the Third Offense, the offending service will be taken offline and placed in a Suspended State. The service will then be queued to be automatically terminated within 24 hours.
  • 2.2.3.2. All remaining services of the Service Owner on the Owner’s Account will also be taken offline and placed in a suspended stated.
  • 2.2.3.3. BuyHostingNow will open a Support Ticket with the owner of the service that will detail the offense and the action taken.
  • 2.2.3.4. A Violation Fine of $500 will be issued to the Service Owner if the offense was found to be intentional or as a result of negligence
  • 2.2.3.5. The remaining services on the account will be reactivated once the Service Owner replies to Support Ticket acknowledging the issue(s) that led to the specific Service termination and service suspensions, and pays the AUP Violation Fine in full.
